These Terms of Service (“Terms”) govern your use of services provided by Brainox Tech (“we,” “our,” or “us”), including the platforms and brands we operate such as:

  • Brainox AI – AI-based SaaS tools, automation, and digital productivity solutions.
  • Doxmate – Our healthcare AI platform offering appointment automation and WhatsApp-based patient engagement services for hospitals and clinics.
  • Agency Services – Meta Ads management, performance marketing, campaign optimization, and related digital services.

By accessing or using any of our websites, platforms, or SaaS products, including brainoxai.com and doxmate.in, you (“you,” “your,” “user,” or “client”) agree to these Terms. If you disagree, you must stop using all services.

1. Eligibility

You must:

  • Be at least 18 years old or the legal age of majority in your jurisdiction.
  • For healthcare SaaS (Doxmate), you confirm you are authorized to represent the hospital, clinic, or healthcare organization registering the account.

2. Services Provided

2.1 Brainox AI (brainoxai.com)

We provide AI-powered SaaS tools including automation, chat solutions, productivity utilities, and other AI-based business tools.

2.2 Doxmate (doxmate.in)

We provide an AI-powered healthcare SaaS platform enabling clinics/hospitals to automate:

  • Appointment booking
  • Rescheduling
  • Patient reminders
  • WhatsApp Cloud API–based communication

2.3 Agency Services

Meta Ads campaign management and optimization.

We may update or discontinue features at any time with reasonable notice.

3. User Responsibilities

You agree to:

  • Provide accurate and updated information when registering or using our platforms.
  • Maintain confidentiality of your account credentials.
  • Use the services only for lawful purposes and in compliance with applicable healthcare, advertising, and data protection laws.

You must NOT:

  • Gain unauthorized access to our systems.
  • Misuse Meta/WhatsApp APIs or violate their policies.
  • Upload harmful files, spam, or malicious content.
  • Use Doxmate for any purpose other than clinical/hospital appointment-related functions.

4. Data & Privacy

  • We process data in accordance with our Privacy Policy (published separately on our websites).
  • For Brainox AI: We may process user-generated content and data necessary to provide AI-based functionality.
  • For Agency services: We may access and process Meta Ads data on your behalf.
  • For Doxmate:
    • We process patient data only for the purpose of enabling appointment management and communication tasks on behalf of your clinic/hospital.
    • We do not sell or rent personal data to third parties.

You are responsible for ensuring your use of our healthcare tools aligns with medical confidentiality and patient data regulations applicable in your jurisdiction.

5. Security

  • Our platforms (Brainox AI and Doxmate) are hosted securely on AWS with strict access controls.
  • WhatsApp Cloud API communication in Doxmate is protected by Meta’s security standards.
  • No digital system is 100% secure. You acknowledge that you use all services at your own risk.

6. Payments & Billing

  • Agency service fees are billed according to mutually agreed contracts or invoices.
  • Brainox AI and Doxmate SaaS subscriptions operate on monthly, annual, or custom billing cycles.
  • Refund & cancellation terms are defined in our Refund & Cancellation Policy (published separately).

7. Intellectual Property

  • All software, tools, AI models, UI/UX designs, systems, branding, and content across Brainox AI and Doxmate belong to Brainox Tech.
  • We grant you a limited, non-transferable license to use our SaaS tools for your internal operations.
  • You may not copy, resell, reverse-engineer, or replicate our services without written permission.

8. Third-Party Services

Our services depend on third-party technologies and APIs including:

  • Meta (WhatsApp, Facebook, Instagram)
  • AWS
  • Other AI infrastructure providers

By using our services, you agree to comply with all relevant third-party policies.
We are not responsible for downtime, restrictions, or changes imposed by these third parties.

9. Limitation of Liability

We are not responsible for:

  • Indirect or consequential damages
  • Loss of profits, data, or business opportunities
  • Errors caused by third-party integrations (Meta, AWS, WhatsApp API, etc.)

Our total liability for any claim will not exceed the amount paid by you in the 3 months preceding the claim.

For Doxmate (healthcare):
We do NOT provide medical advice.
We only provide scheduling and communication tools.
All medical decisions remain solely with your healthcare organization.

10. Termination

We may suspend or terminate your access if:

  • You violate these Terms
  • You misuse any SaaS platform
  • Required by law or by third-party API restrictions

You may request termination of your account at any time.

11. Changes to Terms

These Terms may be updated periodically.
We will revise the “Last Updated” date accordingly.
Continued use after changes indicates your acceptance.

12. Governing Law

These Terms are governed by the laws of Bundi, Rajasthan, India.
All disputes will be resolved exclusively in the courts of Bundi, Rajasthan.
